A group of six individuals are appealing a judge's decision throwing out a civil suit against the Town of Fort Erie and the Molinaro Group over the Crystal Beach Gateway condo development.

The judge's ruling also forced the six to pick up the legal costs for both the town and the developer...to the tune of more than 135 thousand dollars.

A date for the appeal has not been set.

Residents have been trying to stop the sale of part of Bay Beach lands..which the town purchased in 2001... to Molinaro Group.
